German law distinguishes between consumers and entrepreneurs. This is fundamental for terms and conditions, information obligations, cancellation, etc.
Claude distinguishes between Consumer and Business and also uses the words enterprise and commercial. But beware: those using Claude Free, Pro & Max plans are considered consumers - even if payment is made and also as entrepreneurs under German law.
In the TOS (= terms of service) of the Claude consumer terms, it states: "You are considered a consumer if you use our services entirely or predominantly outside of your commercial, business, trade, or professional activity."

And what applies now for entrepreneurs?
Für die kommerziellen Produkte wie API-Schnittstellen und claude for work gelten die Business Associate Agreements (BAA) für Geschäftskunden. Gerichtsstand ist Irland, anwendbares Recht ist irisches Recht. So was kann im Bereich B2B vereinbaren.
However, it also states: Standard Claude Enterprise plans do not include BAA coverage without actions from an administrator.
But what applies now for all those who use Claude for their business or as entrepreneurs and do not have a BAA?
Claude clarifies: "The BAA does not cover Workbench and Console, Claude Free, Pro, Max or Team plans, Cowork or currently beta features such as Claude in Office and Claude Design."
Fazit: Dann gelten für viele Unternehmen wohl doch die claude consumer AGB.
Price changes, expiration clauses, jurisdiction - unpleasant surprises abound in the terms and conditions of AI providers. The seminar will include a checklist for AI terms of use. This will be discussed using examples with the aim of understanding the risks and identifying hidden traps using the checklist. With this checklist, the terms and conditions of AI providers can be examined and questioned.
